Terms of Service

1) Eligibility (Adult-Only)

• You must be at least 20 years old (the legal gambling age for casino-style play in New Zealand under the Gambling Act 2003).
• No one under the applicable age may access or use the Service. We may request age verification and suspend or terminate accounts that fail verification.
• You must have legal capacity to enter into a binding contract.

2) Entertainment-Only Social Casino / Arcade

• The Service offers simulated casino/arcade gameplay for entertainment only.
• The Service uses virtual currency/coins and virtual items. They have no real-world value and are not redeemable, transferable, or exchangeable for cash or anything of value.
• No real-money gambling: there is no cash-out, no prizes, and no winnings of anything of real-world value.

3) Accounts & Security

• You are responsible for maintaining the confidentiality of your login credentials and for activity on your account.
• Provide accurate information and keep it up to date.
• We may suspend or terminate accounts to protect users, the Service, or to enforce these Terms.

4) Prohibited Conduct

• Attempting to enable real-money gambling, cash-out, or sale/transfer of virtual coins/items.
• Cheating, exploiting bugs, using bots/scripts, reverse engineering, or interfering with the Service.
• Harassment, hate, unlawful content, or violating others’ rights.
• Accessing the Service if you do not meet the eligibility requirements.

5) Intellectual Property

The Service, including software, design, text, graphics, and trademarks, is owned by us or our licensors and is protected by applicable laws. You receive a limited, revocable, non-transferable license to use the Service for personal, non-commercial entertainment, subject to these Terms.

6) Disclaimers

The Service is provided on an “AS IS” and “AS AVAILABLE” basis. To the maximum extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted, error-free, or secure operation.

7) Limitation of Liability

To the maximum extent permitted by law, Nexspinz Limited will not be liable for indirect, incidental, consequential, special, or punitive damages, or for loss of profits/data, arising from or related to your use of the Service. Our total liability for any claim will not exceed the amount you paid us (if any) in the 12 months before the event giving rise to the claim.

8) Termination

You may stop using the Service at any time. We may suspend or terminate access to the Service (including any account) at any time for suspected violations of these Terms, security reasons, or to comply with law.

9) Governing Law & Venue

These Terms are governed by the laws of New Zealand, including the Gambling Act 2003, the Consumer Guarantees Act 1993, and the Fair Trading Act 1986. Disputes will be resolved by the Disputes Tribunal of New Zealand where eligible, or otherwise by the courts of New Zealand, and you submit to the non-exclusive jurisdiction of those courts.

10) Changes to These Terms

We may update these Terms from time to time. The “Last updated” date shows when changes were made. Your continued use of the Service after changes become effective means you accept the updated Terms.
